US Tracking Label Requirements for Baby Toys

If you sell wooden baby toys or any children's product in the US, every item needs a permanent tracking label. The requirement is short, specific, and routinely treated as a printing afterthought. It should be decided at sampling, because the label is part of the product, not part of the carton.

This guide covers the four required elements, where the label must appear, how to define a batch number that means something, and where suppliers typically get it wrong.

The four required elements

Under 15 U.S.C. 2063(a)(5)(A), the label must carry permanent, distinguishing marks that allow the product to be traced. The elements are:

ElementWhat it looks likeCommon mistake
Manufacturer, importer or private labeler nameLegal entity name, not a brand nicknameTrading name that does not match the CPC
Production locationCity and country; some guidance allows country plus a factory code"Made in China" only, with no production site
Production dateMonth and year at minimumYear only, or the ship date
Batch, run or lot number, or other identifying characteristicA code that maps to a production runA batch number that changes per carton, not per run

The purpose is not decoration. It is to let a regulator, retailer or consumer trace a specific item to a specific production run — which is what makes a targeted recall possible instead of a blanket one.

Where the label must go

The rule is "on the product and on its packaging, to the extent practicable". Two surfaces, two contexts:

  • On the product itself. Permanently affixed or printed — laser, stamp, engraving, printed on a sealed surface, or a durable label. A sticker that peels in a nursery is not permanent.
  • On the packaging. The retail packaging must carry the same traceability information, because the packaging is often what the consumer keeps and what the retailer scans.

For a small wooden teether, "practicable" is the operative word. A small item may not have room for four lines on the product. That does not make the product exempt. It means the label goes on the smallest practicable surface, the packaging carries the full set, and the rationale is documented in the technical file.

For private label orders, the importer or brand owner's name and address replace the factory's on the label — but the production location and date still describe the factory. Getting this split right is one of the most common OEM mistakes.

Define the batch number before the PO

A batch number is a production concept, not a shipping concept. Before the order is placed, agree with the supplier:

  1. What counts as one batch: one production run of one SKU, one colourway, one shift, or one PO line.
  2. How the number is constructed: date code plus line plus sequence, or a supplier-defined code with a lookup table.
  3. Who records it: the factory writes it, the QC report references it, and the importer keeps the mapping.
  4. How test reports link to it: the report may reference a sample, and the batch record is what ties production to that sample.
  5. What happens on a second run: a reorder needs a new batch number, not the old one.

If a supplier cannot explain how its batch code is built, the traceability chain ends at the label.

Where suppliers get it wrong

FailureWhy it matters
Label only on the colour boxIf the packaging is discarded, the product is untraceable
Batch number changes per cartonNo way to group items by production run
Production date is the ship dateThe date no longer reflects manufacturing
Name on label does not match the CPC issuerInconsistent file, rejected during review
Label applied after QC inspectionNo photo record and no link to the inspection report
Private label artwork omits the importer's legal nameThe label cannot identify a responsible US party

What belongs in a label data sheet

A label data sheet is the one-page document that lets a printer, a brand owner and an importer agree on the label without a meeting. We prepare one per model for private label and OEM orders. It should include:

  • The four required elements, as literal text.
  • Placement drawing: product surface and package panel.
  • Method: laser, stamp, print or label.
  • Language and font size requirements.
  • Warning text and age grading, in the market's language.
  • Barcode and FNSKU/UPC placement for marketplace orders.
  • Approval signature and date, with a revision number.

Once approved, that sheet is the version of record. If the artwork changes after production starts, the file diverges from the product.

FAQ

Q: Is a tracking label the same as a warning label?

No. The tracking label carries traceability: who made it, where, when, and which run. The warning label carries safety information and age grading. Many products carry both.

Q: Can the batch number be added on the carton only?

No. The requirement extends to the product and its packaging to the extent practicable. A carton-only code does not identify the item if the item is separated from the carton.

Q: Does the label need to be in English?

The US requirement is about content, not language, and English is standard for the US market. Products sold in other markets still need their own language requirements met — the US label does not satisfy Canada's bilingual rules, for example.

Q: We are the brand owner, not the factory. Whose name goes on the label?

The name of the manufacturer, importer or private labeler, depending on who is responsible. For a US private label order, the brand owner's legal entity typically appears, with the factory's production location and date.

For the full US document set, see CPSIA and the CPC. For batch and production data on the certificate, read CPSIA and the CPC for wooden baby toys. Labelling is also a private label decision — see how we handle private label and OEM orders, or send your artwork requirements through the quote form.

This is a commercial explainer, not legal advice. Certification is model-specific and market-specific.
