CPSIA and the CPC for Wooden Baby Toys

If you import 0–3 wooden toys into the United States, two documents decide whether your container clears: a third-party test report from a CPSC-accepted laboratory, and a Children's Product Certificate (CPC) signed on the US side. Suppliers routinely conflate them. They are different documents, with different owners.

What CPSIA actually requires for a 0–3 wooden toy

CPSIA is an umbrella law. The requirements that hit a wooden baby toy sit in separate rules, and each is cited on the CPC.

RuleWhat it requiresWhere it bites
ASTM F963-23, mandatory via 16 CFR 1250.2Toy safety standard; the CPC must list the specific F963 sections that applyReports still on F963-17
16 CFR 1501No small parts at all for toys intended for children under 3Loose beads, bells, glued dowels, removable pegs
16 CFR 1510A rattle must not fit entirely into the test cavity, before or after abuse testingThin handles, small bell chambers
16 CFR 1303Lead in paint and surface coatings ≤ 90 ppmDark paints, recycled timber, decorative print
15 U.S.C. 1278aTotal lead in accessible substrate ≤ 100 ppmPainted or varnished solid wood
16 CFR 1307Eight phthalates ≤ 0.1% eachSilicone parts, grips, teething beads, printed ink
15 U.S.C. 2063(a)(5)(A)Permanent tracking label on product and packagingLabels added after production starts

Two details separate the US from other markets. Under 16 CFR 1500.18(a)(9), a small part in an under-3 toy makes the product a banned hazardous substance — no warning label fixes it. And the CPC must cite the F963 sections that apply rather than only "16 CFR part 1250"; marketplace reviewers increasingly check for this.

Who issues the CPC — and why your supplier cannot

The CPC is issued by the US importer or the US domestic manufacturer. A Chinese factory or trading company cannot issue a valid one, because the certificate asserts that the signer complied with CPSC rules and holds the underlying records. That is a US-side obligation.

What a supplier can provide:

  1. The test report from a CPSC-accepted laboratory, in English.
  2. Manufacturing data the CPC needs: factory name and address, production dates, batch numbers.
  3. Component and material breakdowns so the lab can scope the test correctly.
  4. Tracking label artwork and the label data sheet.

What a supplier cannot provide: a signed, valid CPC. If a supplier offers one, check everything else in the file.

The seven elements of a CPC

A complete CPC carries all seven. Missing any one is a common rejection reason.

  1. Identification of the product covered (model, SKU, colour).
  2. Citation to each CPSC rule or regulation the product is certified against.
  3. Name, full mailing address and telephone number of the US importer or domestic manufacturer issuing the certificate.
  4. Contact information for the individual maintaining records of the test results.
  5. Date and place of manufacture (month and year, plus city and country).
  6. Date and place the product was tested.
  7. Identification of the third-party laboratory, including its CPSC acceptance.

How to read a US test report in eight minutes

  1. Check the lab. The header must identify a CPSC-accepted laboratory and its accreditation scope. A CNAS-only report is not a substitute.
  2. Read the sample description. It should name the model, colour, materials and age grade. If it says only "wooden toy", the report does not cover your SKU.
  3. Check the standard edition. ASTM F963-23 is the version referenced by 16 CFR 1250.2. A report against F963-17 does not evidence conformity today.
  4. Count the clauses. Look for 1501, 1510 (if applicable), 1303, 1307 and the F963 section list.
  5. Match colourways and materials. A report on the natural-wood version does not automatically cover the painted version.
  6. Check the conclusion and signature. A valid report has pass/fail per clause and is signed by the lab, not the factory.
  7. Check the dates. The test date must precede the production date on the CPC.
  8. Check traceability. Does the report reference a sample you can tie back to the batch you are buying?

If the file fails at step 1, 2 or 3, ask for a proper report before discussing price.

From 8 July 2026, most regulated consumer products including children's products must have certificate data filed electronically with CBP through the PGA Message Set. In practice, that means CPC data has to exist in structured, machine-feedable form.

FAQ

Q: Can a Chinese factory issue a CPC?

No. The US importer or US domestic manufacturer issues it. The factory supplies the report and manufacturing data behind the certificate.

Q: Is a CPSIA test report the same as a CPC?

No. The report is laboratory evidence. The CPC is a certificate signed by the US-side responsible party that cites the rules and the underlying records.

Q: Our supplier sent an F963-17 report. Is it still valid?

It no longer evidences conformity to the version referenced by 16 CFR 1250.2, which is ASTM F963-23. Expect a retest or a report amendment.

Q: What if a small part comes loose during testing?

The product fails 16 CFR 1501, and no warning label can rescue it. The fix is at design stage: change the joint, dowel diameter or component size.

If you are building a first US order, start with our CPSIA and CPC reference, then check the current standard in F963-23 vs F963-17 and the labelling side in US tracking label requirements. For a model-specific answer, send the destination market and target age grade through the quote form.

This is a commercial explainer, not legal advice. Certification is model-specific and market-specific.
